1. License
We grant you a personal, non-transferable, non-exclusive, revocable license to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.
2. Your account
You are responsible for your account and for keeping your credentials secure. You may delete your account at any time in the app (Profile → Settings → Delete account).
3. Subscriptions (auto-renewable)
- What it is. Catopia offers an optional auto-renewable subscription, Catopia Pro, in two durations:
- Catopia Pro Monthly, 1 month, 6.99 USD
- Catopia Pro Annual, 1 year, 69.99 USD
Prices are shown in the app in your local currency before purchase and may vary by region.
- What it buys. An exclusive welcome cosmetic, an exclusive gold app icon, much faster Cancat and Catnip regeneration, a tripled stash, doubled daily quest rewards, a wider view on the community map, more cats revealed on it, cat rarity shown at a glance, better odds of meeting a legendary cat, and more training sessions.
- Payment is charged to your Apple ID at confirmation of purchase.
- Auto-renewal: the subscription renews automatically unless canceled at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
- Manage or cancel anytime in Settings → Apple ID → Subscriptions on your device. Deleting the app does not cancel a subscription.
4. Virtual items and currencies
The app includes virtual currencies and items (e.g. Fish, Cancats, Catnip, Golden Bells, cosmetics). These have no monetary value, cannot be exchanged for real money, and are non-transferable. Purchases of virtual items are generally final and non-refundable except where required by law or Apple's policies. We may adjust, expire, or discontinue virtual items.
5. Acceptable use
Do not cheat, exploit, reverse engineer, disrupt, or misuse the app, and do not submit unlawful or infringing content. We may suspend or terminate accounts that violate these Terms.
6. Disclaimers and liability
The app is provided "as is" without warranties to the maximum extent permitted by law. To the extent permitted by law, our liability is limited, and we are not liable for indirect or incidental damages.
7. Termination
We may suspend or end your access if you breach these Terms. You may stop using the app and delete your account at any time.
8. Governing law and changes
These Terms are governed by the laws of France. We may update these Terms; continued use after changes means you accept them.
9. Apple
This section applies because the app is distributed through the App Store. It reproduces the minimum terms Apple requires of a custom End User License Agreement, and the same text is filed with Apple in App Store Connect.
- Acknowledgement. These Terms are concluded between you and us only, and not with Apple. We alone, not Apple, are responsible for the app and its content.
- Scope of the license. The license granted in section 1 is limited to a non-transferable license to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.
- Maintenance and support. We alone are responsible for providing any maintenance and support for the app. Apple has no obligation whatsoever to furnish any maintenance or support services for the app.
- Warranty. We alone are responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our sole responsibility.
- Product claims. We, and not Apple, are responsible for addressing any claims relating to the app or your possession and use of it, including but not limited to product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- Intellectual property rights. If a third party claims that the app or your possession and use of the app infringes that third party's intellectual property rights, we, and not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a terrorist supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer name and address. Questions, complaints or claims about the app should be directed to Kévin Psalmon, 3 rue des 7 Dormants, 45000 Orléans, France, contact@catopia.app.
- Third party terms. You must comply with any applicable third party terms of agreement when using the app.
- Third party beneficiary. Apple and Apple's subsidiaries are third party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right, and is deemed to have accepted the right, to enforce these Terms against you as a third party beneficiary of them.
